Terms of Use

These terms explain the rules for using Notch and Notch Plus. Notch is deliberately local-first: there is no Notch account, advertising network, analytics service, or developer-operated cloud database.

1. Agreement and licence

By downloading, using, or subscribing through Notch, you agree to these Terms of Use. Your licence to the iOS app is also governed by Apple's Standard Licensed Application End User License Agreement. These terms supplement that agreement and do not replace rights that cannot lawfully be excluded.

2. What Notch provides

Notch provides daily habit tools, guided practice content, clocks for recovery, routines and events, local reminders, widgets, backups, and optional Game Center progress. Notch is a self-management tool, not medical care, diagnosis, treatment, counselling, or emergency support. Do not rely on it where professional advice or urgent help is required.

4. Privacy and data

Detailed habits, clocks, logs, and programme progress are stored locally on your device in storage shared with the Notch widget. Notch does not operate an account system or backend that receives this data.

If you choose to connect Game Center, Notch sends Apple only aggregate totals, achievement identifiers, and completion percentages. It does not send habit names, clock names, detailed logs, or backup contents. Apple processes purchases and Game Center activity under its own terms and privacy policies.

Exports are readable, unencrypted JSON files created at your request. You decide where to save or share them. You are responsible for keeping device access and exported backups secure. Read the full Notch Privacy Policy.

5. Your responsibilities

You may use Notch only lawfully and for personal purposes. You must not attempt to disrupt the app, bypass purchase controls, extract or redistribute paid programme content, infringe intellectual-property rights, or use Notch in a way that harms another person or violates applicable third-party terms.

6. Ownership

Notch, its design, code, branding, and original guided-practice content belong to the developer and are protected by intellectual-property laws. Your licence is personal, limited, non-exclusive, non-transferable, and subject to the Apple usage rules. You retain responsibility for the data and text you enter.

7. Availability and changes

Reasonable care is taken to keep Notch available and accurate, but uninterrupted or error-free operation is not guaranteed. Features may change to improve the product, protect privacy or security, comply with law, or maintain compatibility with Apple platforms. Material changes to these terms will be posted here with a revised effective date.

8. Data loss and backups

Because Notch is local-first, deleting the app, losing or resetting a device, clearing browser storage, or restoring without a suitable device backup may remove data that the developer cannot recover. Use Notch's export feature and protect the resulting file if the history matters to you.

9. Warranties and liability

Nothing in these terms excludes or limits liability where doing so would be unlawful, including mandatory consumer rights or liability for fraud, fraudulent misrepresentation, death, or personal injury caused by negligence. Otherwise, to the maximum extent permitted by law, Notch is provided without guarantees beyond those required by law, and the developer is not responsible for indirect or unforeseeable loss, lost opportunity, or loss caused by failing to keep a backup.

10. Suspension and termination

You may stop using Notch at any time. The developer may restrict access where reasonably necessary to address unlawful use, security risk, intellectual-property infringement, or abuse of the service. Ending use does not automatically cancel an App Store subscription; cancellation must be completed through Apple.

11. Governing law

These terms are governed by the laws of England and Wales. If you are a consumer, this choice does not remove mandatory protections or court rights available in the country where you live.
